Our firm has a tradition of following our clients and their businesses through each generation. In personal estate planning, we strive to help our clients design their plans to meet all their personal objectives and avoid adverse tax consequences and future probate fees.
We work closely with owners and principals, their children or designees in order to design and execute a strategy for business to ensure that all tax-related matters are considered including
wealth transfer issues, asset protection, limitation of liability and generational business and family
planning.
One key goal of the firm is to develop strategies for each client and business owner encompassing tax minimization, asset protection and effective and efficient wealth transfer and security. We pay special attention to shielding families and individuals from unwanted liability and exposure, especially in high-risk business and professional practices. Hutchings Barsamian works with key advisors throughout the country and internationally who provide recommendations for complex business issues. We are proud of the Estate, Trust and Tax professionals of the firm. The counsel and services provided within the realm of employment law encompass many concerns and questions employers and businesses face every day. These include questions about employment handbooks, personnel manuals, employment and separation agreements, restrictive covenants, policies and procedures required by law or recommended for proactive reasons, legal concerns pertaining to hiring and termination procedures, discrimination, diversity, harassment, confidentiality, wage and hour law, workers’ compensation and unemployment.
Consistent with our mission of effectively serving our clients, we encourage businesses to approach employment concerns proactively, taking preventive measures to create a work environment of respect and civility and to prevent complaints, claims and litigation from ever being initiated or becoming necessary. Never more so than in the workplace is the old adage “An ounce of prevention is worth a pound of cure” so relevant and true. We work with our business clients as partners in prevention, reviewing their materials and policies, providing awareness training for their employees on harassment and discrimination issues, and advising them before they take employment-related actions to prevent those actions that have adverse consequences.
Hutchings Barsamian partners with our clients proactively to
position them properly to give us an advantage in representing
them should complaints or litigation arise. Because we take the
time to know our business clients and assist them along the way,
we are better equipped to assist them in resolving disputes,
either by utilizing cutting edge methods like collaborative law
or when necessary, to defend them in litigation. Working
together with our clients, we address issues before they become
problems. Through this approach, we minimize business risks and
provide value.
Our firm also provides counsel and representation to individuals who present legitimate complaints of discrimination, harassment, wrongful or unlawful treatment by employers, as well as those who need advice and review of employment or separation agreements. We are committed to the principle of a workplace free from harassment, discrimination or an otherwise hostile environment. While our mission in fulfilling this principle with our business clients is to create and maintain a respectful workplace, our role also extends to that person whose fundamental rights to certain protections in the workplace have been violated.

Anyone who has been involved in litigation knows from his or her own experience that it is a costly, time-consuming, emotionally draining and often ineffective way to resolve issues. We recognize this as well and while we are ready to represent our clients down the path of litigation, we work to first utilize more client-based means of achieving the desired results. These include approaches such as collaborative law, in which disputing parties and attorneys commit to a problem-solving,
interest-based, non-adversarial method of representation without litigation.
We also provide mediation services to those who need the
assistance of a third party neutral in resolving business or
employment disputes
These alternative means of solving conflicts often provide results that are less costly, less emotionally draining, less taxing on business relationships and quicker than traditional litigation. In utilizing collaborative law, Hutchings Barsamian attorneys engage in a process of settlement by intention, responsive to the fact that 98% of the cases filed with courts are settled. While we recognize that there is a time and place for litigation, staying consistent with our mission of most effectively serving our clients’ needs, we first try to avail ourselves of alternative dispute resolution.

| Litigation is one element of a broader focus our firm has in assisting its clients to resolve their disputes favorably. These may include business disputes, personal injury or negligence cases, employment-related issues or conflicts based on consumer protection or unfair business practices. Our goal is to prevent, engage and resolve conflict long before it reaches the point of litigation. But should it come to litigation, our firm provides experienced representation
and zealous advocacy in the traditional litigation venues of the courts, administrative tribunals and arbitration.

Elder Law practice, also referred to as Medicaid Law, is the direct result of our growing senior citizen community and the ever-expanding governmental role in their lifestyles. Before the 1980s and 1990s, the world was a much simpler place for the retired senior citizens. Today our seniors are faced with the complicated elements of Medicaid regulations, Supplemental Health Insurance, Long Term Care Insurance, Medicaid Planning, Nursing Home Financing and Planning, long term annuities, advocacy for the elderly and more. Our firm provides the legal guidance and expertise needed to assist the elderly through the questions and issues they face, as well as to offer experienced counseling and representation in Medicaid planning.
Probate and Family Court Law is the legal system for settling estates and the assigning of guardians and conservators when necessary or appropriate. Our firm brings over 30 years of experience, a solidly developed relationship with and knowledge of these courts, their workings and personnel. This knowledge and practical experience most often leads to relatively fast results, which benefits our clients and their families. |
